Workshop Terms & Conditions
These Terms govern participation in any training session conducted by Shimicoat Pty Ltd at its Bibra Lake warehouse or any other designated venue. By enrolling in or attending a Shimicoat training session, you agree to be bound by these Terms. Please read this document carefully before booking.

1Definitions
In these Terms, unless the context requires otherwise:
- "Shimicoat" means Shimicoat Pty Ltd (ABN 28 622 871 283), trading inclusive of the SHIMIPRO™ brand.
- "Participant" means any individual enrolled in, attending, or registered for a Session.
- "Session" means any training course, workshop, demonstration or instructional event delivered by or on behalf of Shimicoat.
- "Confidential Information" means any non-public information disclosed during a Session, including product formulas, application techniques, manufacturing processes, pricing, customer information, and business strategy.
- "Venue" means the Shimicoat Bibra Lake warehouse or any other premises designated by Shimicoat for the delivery of a Session.
2Filming, Photography & Media Consent
2.1 Sessions will be filmed, photographed, audio-recorded, and may be live-streamed. By attending, the Participant consents to this and to the resulting material being used by Shimicoat for marketing, advertising, social media, internal training, and product demonstrations.
2.2 The Participant grants Shimicoat a perpetual, royalty-free, worldwide licence to use, edit, and distribute this material. All footage and images remain the property of Shimicoat Pty Ltd; the Participant retains no rights over them.
2.3 Consent for future use can be withdrawn in writing, but anything already published cannot be retracted.
2.4 Participants must not film, photograph, or record any part of a Session on personal devices without prior written consent from Shimicoat.
3Booking, Payment & Refunds
3.1 The workshop fee is $1,430 AUD (inc. GST) per person. Bookings are limited to 20 spots per Session and are sold on a first-paid, first-served basis. All fees are quoted in Australian Dollars.
3.2 Payment must be received in full prior to the commencement of the Session. Payment is processed securely via Stripe.
Cancellation by you
3.3 Cancellations made more than 7 days before the scheduled Session date are eligible for a full refund.
3.4 Cancellations made within 7 days of the Session are non-refundable but may, at Shimicoat's discretion, be transferred to a future Session date or to another nominated person.

3.5 If Shimicoat cancels or reschedules a Session, the Participant will be offered a full refund or transfer to an alternative date, whichever the Participant prefers.
3.6 Shimicoat is not liable for any costs incurred by Participants as a result of a Session cancellation or rescheduling, including travel or accommodation expenses.
3.7 A Participant who fails to attend without notice forfeits their enrolment with no refund.
4Health & Safety
4.1 All Participants must comply with Shimicoat's Work Health and Safety (WHS) policies, the Work Health and Safety Act 2020 (WA), and any site-specific safety requirements in effect at the Venue.
4.2 Participants must wear all required personal protective equipment (PPE) as directed by the trainer or Shimicoat staff during practical demonstrations. Closed-toe footwear and long sleeves are required at all times in the workshop area. Steel-capped boots are strongly recommended.
4.3 Shimicoat accepts no liability for injuries, illness, or damages sustained as a result of a Participant's failure to follow safety instructions or comply with WHS requirements.
4.4 Any Participant who observes a safety hazard must report it immediately to the trainer or a Shimicoat representative.
4.5 Participants with known health conditions, allergies, or sensitivities that may be affected by the training environment, including exposure to chemical products, dust, or fumes, are responsible for notifying Shimicoat in writing prior to the Session.
4.6 Participants must be physically and mentally fit to participate. Shimicoat reserves the right to refuse participation where, in its reasonable opinion, a Participant's condition presents a safety risk to themselves or others.
5Drugs, Alcohol & Code of Conduct
5.1 All Participants are expected to behave in a professional, respectful, and cooperative manner throughout the duration of the Session.
5.2 Disruptive, threatening, aggressive, or unsafe conduct will not be tolerated and may result in immediate removal from the Session without refund.
5.3 Any damage caused to Shimicoat's property, equipment, or facilities by a Participant will be the financial responsibility of that Participant.
5.4 Shimicoat reserves the right to take further action, including restricting future participation and notifying the Participant's employer, in response to any serious breach of conduct.
6Sexual Harassment & Respect at Work
Shimicoat is committed to providing a safe, respectful, and inclusive training environment, free from sexual harassment, sex-based harassment, and hostile workplace conduct, in accordance with its positive duty under the Sex Discrimination Act 1984 (Cth) (as amended by the Anti-Discrimination and Human Rights Legislation Amendment (Respect at Work) Act 2022).
6.1 Sexual harassment is any unwelcome conduct of a sexual nature in circumstances in which a reasonable person would have anticipated the possibility that the recipient would be offended, humiliated, or intimidated. This includes, but is not limited to, unwelcome touching, sexual comments or innuendo, suggestive looks, requests for sexual favours, sexually explicit communications (including via electronic means), and the display of sexually explicit material.
6.2 Sex-based harassment, hostile conduct on the ground of sex, and any form of discrimination, bullying, or victimisation based on a protected attribute (including but not limited to sex, gender identity, sexual orientation, race, age, disability, religion, marital or family status, or pregnancy) are strictly prohibited.
6.3 Participants, trainers, contractors, and visitors are all required to behave respectfully toward each other at all times during a Session, including during breaks, social activities, and any travel arranged in connection with a Session.
6.4 Any Participant who experiences or witnesses sexual harassment, discrimination, bullying, or hostile conduct is strongly encouraged to report it immediately to the trainer, a Shimicoat representative, or directly to Shimicoat management at the contact details below. Reports will be handled confidentially, sensitively, and without retaliation.
6.5 Shimicoat reserves the right to take immediate action in response to any breach of this clause, including removal from the Session without refund, restriction from future Sessions, reporting to the Participant's employer or referring agency, and reporting to relevant authorities or regulators where appropriate.
6.6 Nothing in these Terms limits a Participant's right to raise a concern or make a complaint with the Australian Human Rights Commission, the Equal Opportunity Commission of Western Australia, the Fair Work Commission, WorkSafe WA, or any other relevant authority.
7Intellectual Property & Confidentiality
7.1 All training materials, presentations, manuals, demonstrations, slides, recipe sheets, and course content provided during a Session are the exclusive intellectual property of Shimicoat Pty Ltd.
7.2 Participants may not reproduce, copy, distribute, publish, or share any training materials in whole or in part without the express written consent of Shimicoat.
7.3 Any notes, summaries, or derivative works created by Participants based on Shimicoat training content must not be used for commercial training purposes or shared with third parties. Participants are welcome to use the techniques learned in their own commercial flooring work — that's the point of the training.
7.4 Shimicoat's trademarks, logos, and branding (including SHIMIPRO™) must not be used by Participants without prior written authorisation.
7.5 Sessions may involve the disclosure of Confidential Information. Participants agree to treat all Confidential Information as strictly confidential and must not disclose it to any third party, competitor, or unauthorised individual. This obligation continues indefinitely unless the information enters the public domain through lawful means.
7.6 Any breach of confidentiality may result in legal action and Shimicoat reserves the right to seek damages, injunctive relief, and recovery of legal costs.
8Reasonable Adjustments & Accessibility
8.1 Shimicoat is committed to making its Sessions accessible to all Participants. Participants who require reasonable adjustments — including but not limited to mobility access, dietary requirements, language support, or accommodations for a disability — are encouraged to contact Shimicoat in advance of the Session so arrangements can be made where practicable.
8.2 Where Shimicoat is unable to accommodate a particular adjustment due to safety, technical, or facility constraints, it will discuss alternatives with the Participant in good faith.
9Certification
9.1 Participants who successfully complete a Session may be issued a certificate of completion or attendance record at Shimicoat's discretion.
9.2 Certifications issued by Shimicoat are specific to Shimicoat's products and processes and do not constitute a formal qualification or licence unless otherwise stated.
9.3 Shimicoat reserves the right to revoke certification if it is found that a Participant misrepresented their identity, cheated during assessment, or breached these Terms.
10Force Majeure
10.1 Shimicoat will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by an event outside its reasonable control, including but not limited to acts of God, fire, flood, severe weather, pandemic, epidemic, public health order, government action, civil unrest, industrial action, terrorism, failure of utilities, or supply chain disruption (a "Force Majeure Event").
10.2 If a Force Majeure Event prevents the delivery of a Session, Shimicoat will use reasonable endeavours to reschedule the Session or, where rescheduling is not practicable, refund any fees paid in respect of the affected Session.
11Liability & Disclaimers
11.1 Shimicoat provides training in good faith and makes every reasonable effort to ensure the accuracy and currency of all course content. However, Shimicoat does not guarantee any specific outcome from completing a Session.
11.2 Shimicoat accepts no liability for losses, damages, or claims arising from the application of training content in a Participant's workplace or project.
11.3 Training materials are subject to change as products are updated. It is the Participant's responsibility to verify that information remains current before application.
11.4 Nothing in these Terms excludes, restricts, or modifies the application of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other consumer protection law where such exclusion would be unlawful. Where Shimicoat is permitted by law to limit its liability for breach of a consumer guarantee, its liability is limited, at Shimicoat's option, to: (a) the supply of the services again; or (b) the payment of the cost of having the services supplied again.
11.5 Subject to clause 11.4, and to the maximum extent permitted by Australian law, Shimicoat's total aggregate liability to any Participant in connection with a Session is limited to the cost of the course fee paid, if any.
11.6 The Participant indemnifies Shimicoat against any loss, damage, claim, or expense suffered or incurred by Shimicoat arising out of the Participant's breach of these Terms, negligence, or wilful misconduct.
12Privacy
12.1 Shimicoat collects personal information from Participants including name, contact details, employer, and role for the purpose of administering Sessions, issuing certifications, and managing safety obligations.
12.2 This information is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and Shimicoat's Privacy Policy.
12.3 Personal information will not be disclosed to third parties except where required by law, where necessary to administer the Session, or where the Participant has provided consent.
12.4 Participants may request access to or correction of their personal information by contacting Shimicoat directly.
13Dispute Resolution & Governing Law
13.1 If a dispute arises in connection with these Terms or a Session, the parties agree to attempt to resolve the dispute in good faith through direct discussion before commencing any formal proceedings.
13.2 If the dispute is not resolved within 30 days, the parties agree to attempt mediation through a mutually agreed mediator before commencing court proceedings, except where urgent injunctive relief is required.
13.3 These Terms are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
14General
14.1 Shimicoat reserves the right to amend these Terms at any time. The version in effect at the time you book is the version that applies to your booking.
14.2 If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
14.3 These Terms constitute the entire agreement between Shimicoat and the Participant with respect to Session participation and supersede any prior representations or arrangements.
14.4 A failure or delay by Shimicoat in exercising any right under these Terms does not operate as a waiver of that right.
15Participant Acknowledgement
By completing payment for a Session, the Participant confirms that they have read, understood, and agree to be bound by these Terms in full. The Participant acknowledges in particular their obligations under Clause 2 (Filming, Photography & Media Consent), Clause 3 (Booking, Payment & Refunds), Clause 4 (Health & Safety), Clause 5 (Drugs, Alcohol & Code of Conduct), and Clause 6 (Sexual Harassment & Respect at Work).
